Before the incident, the plaintiff (Roger) was an experienced boat painter. While renting a space in a local boatyard to perform his painting work, Roger was using his ladder to paint the top of a boat. Suddenly, he fell from the ladder, nearly eight feet high. This unexpected fall was due to an uneven surface—a hole in the pavement that should have been attended to by the boatyard’s staff.
Roger sustained the following damages from the accident, and Cohen & Cohen fought to recover compensation for them all:
Cohen & Cohen pursued this case because if the pavement had been repaved or properly repaired before renting Roger the space, he would not have fallen off of his ladder. The boatyard company negligently maintained the premises, causing unsafe working conditions. This meant that Roger suffered painful and permanent injuries, on top of his medical bills and loss of income.
As a result of the slip-and-fall incident, Roger not only endured pain and suffering, but he had to undergo surgery and could not work. These lost wages were on top of his ever-growing medical bills associated with the incident.
